Legal Counsel Is Helpful When Spousal Support Issues Arise
When you and your spouse file for divorce, there will be many issues that the two of you need to discuss and, ultimately, settle. One of these could be spousal support (often called alimony), though it will depend on your specific circumstances. Not every divorce has spousal support involved. It will be up to a judge to determine if spousal support should be involved in your divorce.
The courts will look at a wide variety of factors when they determine if alimony is justified in your case or not. They will look at the length of the marriage; the relative health of the spouses involved; the incomes and financial stability of the two spouses; the property owned by the two spouses; the age of the spouses; and many other important life factors.
If spousal support is awarded, then it would behoove the two spouses to track the payments. Keep a spreadsheet of information that tracks the dates of any payments, the amount of any payments, the addresses used for the payments, and any other basic financial information (check number, bank used, routing number) tied to the payment. If the paying spouse doesn’t use checks, then cash payments will require the two of you to create a paper receipt that both of you sign.
